This application for anticipatory bail arises out of Sitamarhi P.S. Case No. 541 of 2018 for the offence punishable

Patna High Court CR. MISC. No.29796 of 2019(2) dt.07-05-2019 2/3 under Sections 147, 323, 324, 325, 307 341, 379 and 504 of the Indian Penal Code.

There are 12 persons, named in the First Information Report, who are petitioners in the present application. Land dispute is apparently the reason behind the occurrence in relation to which case and counter case has been filed. There is allegation against the accused persons of having assaulted the informant variously and taken away certain cash. The petitioners do not have any criminal history and since the occurrence is said to have taken place because of land dispute, I am inclined to allow this application, which is accordingly allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in Sitamarhi P.S. Case No. 541 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case
