The petitioner seeks bail in connection with Special POCSO Case No. 78 of 2022, arising out of Industrial Area P.S. Case No. 75 of 2022 dated 04.05.2022 registered for the offence punishable under Sections 354B of the Indian Penal Code and Section 8 of the POCSO Act, 2012.

The allegation against the petitioner is that he caught hold the informant's hand, pressed her mouth and taken away in the orchard.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The petitioner himself surrendered before the learned Court below. Charge-sheet has already been submitted and there

Patna High Court CR. MISC. No.32051 of 2023(2) dt.07-07-2023 2/2 is no chance of absconding the petitioner or tampering with the evidence. Petitioner is in jail custody since 06.01.2023, having no criminal antecedent.

Learned APP appearing for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, let the petitioner above named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-VI, Bhagalpur in connection with Special POCSO Case No. 78 of 2022 arising out of Industrial Area P.S. Case No. 75 of 2022.
