====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 07-05-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Sahodara P.S. Case No. 02 of 2018, instituted for the offence under Section(s) 302, 120-B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioner submits that there is no allegation of any specific overt act against petitioner in the First Information Report. There is allegation against Sheikh Shabbu of firing on neck of father of the informant. The informant has named five accused persons in the First Information Report. Petitioner is not named in the written report. The name of petitioner has come during investigation in

Patna High Court CR. MISC. No.29097 of 2019(2) dt.07-05-2019 2/2 the confessional statement of co-accused Pappu Patel. Petitioner is in custody since 15.12.2018.

Counsel for the State submits that 6 other cases are pending against the petitioner. Counsel for the petitioner submits that petitioner is on bail in all those cases. Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West Chamapran at Bettiah, in connection with Sahodara P.S. Case No. 02 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
