The petitioner seeks bail in Shivsagar P.S. Case No. 361/2018, instituted for offence under Section(s) 364A, 302 and 201 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. Name of this petitioner has been disclosed by Brij Kumar Patel @ Chunnu in his confessional statement.

It is alleged in the written report that some call was made on the mobile phone of son of informant by mobile number as mentioned in the written report.

Learned counsel for the petitioner has submitted that during investigation aforesaid mobile number was found

Patna High Court CR. MISC. No.29841 of 2019(2) dt.08-05-2019 2/2 registered in the name of Jay Kumar Singh, s/o Chhedi Singh. Petitioner has no concern with the aforesaid mobile. It has been further submitted that dead body of son of informant was found in the river on the basis of confessional statement of co-accused Jay Kumar Singh and others.

Petitioner is in custody since 09.11.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Shivsagar P.S.
