JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Mansi P.S. Case No. 03 of 2019, registered for the offence punishable under Sections 304B, 201/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along other accused persons committed murder of informant's daughter due to non-fulfillment of demand of dowry.

It is submitted on behalf of the petitioner that no such occurrence has taken place and petitioner has been falsely implicated in this case due to ill motive. As a matter of fact, daughter of informant had performed inter caste marriage without consent of her parents. The deceased was found in unnatural circumstances. It is a case of honour killing. Patna High Court CR. MISC. No.43473 of 2021(3) dt.03-01-2022 2/2 is in custody since 18.02.2021 having no criminal antecedent. Learned APP however, vehemently opposed the prayer for bail and submitted that petitioner is husband of the deceased.

Considering the facts aforesaid and the nature of allegation and the fact that petitioner is husband of the deceased and deceased died in unnatural circumstance within seven years of marriage, I am not inclined to enlarge the petitioner abovenamed on bail.
