The petitioner seeks bail in connection with Khiri More P.S. Case No. 01 of 2020 registered for the offences punishable under Sections 302, 304B, 120B/34 of the Indian Penal Code.
The prosection case in brief started on the basis of written report of Upendra Kumar, son of Late Krishna Ram, resident of village - Wasilpur (Arwal), given before S.H.O. of Khiri More Police Station on 02.01.2020 at about 20.30 hours, alleging inter-alia that on 10.05.2019 at about 12.00 P.M. Anu Kumari daughter of informant was kidnapped with intent to marriage from village- Wasilpur (Arwal) by Dharmendra
Patna High Court CR. MISC. No.30185 of 2020(3) dt.06-01-2021 2/3 Kuamr, son of Ram Pravesh Ram, resident of village- Sidhipur, P.S.- Khiri More, District- Patna who is presently posted in Kerala in C.I.S.F. for which Arwal P.S. Case No.125 of 2019 dated 12.05.2019 was registered under Section 366 I.P.C. It is further alleged that, in that case on 14.05.2019, mother-in-law of Anu Kumari namely Nanda Devi, wife of Ram Pravesh Ram, Bhaisur Devendra Das, son of Ram Pravesh Ram have taken her away from court concerned with assurance at their house at village - Sidhipur, P.S.- Khiri More, DistrictPatna, where daughter of informant was residing peacefully but after some days husband Dharmendra Kumar, mother-in-law Nanda Devi, Bhainsur Devendra Das, younger brother Raghuvendra Ram, Gotni Samngita Devi began to torturing her for demand of dowry and vehicle. Informant given Apache vehicle with assurance that money will provide later on, but they used to torturing her for demand of Rs.5,00,000/- (Five laks).
It is further alleged that subsequently informant learnt that Dharmendra Kumar have illegal relation with another girl, this fact also come in knowledge to daughter of informant then she began to raise objection, whereupon all the aforesaid persons used to assault her and Dharmendra Kuamr ordered to

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. The petitioner was not live at the place of occurrence. The petitioner is the brother-in-law of the husband of the deceased. The petitioner has clean antecedent and the petitioner is in jail custody since 04.01.2020.
Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of Sri Manish Kumar, learned Judicial Magistrate 1st Class, Danapur, DistrictPatna in connection with Khiri More P.S.
