For the Opposite Party : Shri Dr. Indiwar Kumari(App) ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 20-01-2015 The petitioner is alleged to have committed offences punishable under Sections-307, 324 and 341/34 of I.P.C. He has been arrested on 12.1.2014 in connection with the offences. He approached the Court of Sessions Judge, Rohtas at Sasaram for bail by filing B.P. No.145/2014 and the same was dismissed on 28.3.2014. Hence, this application under Section-439 of Cr.P.C.
Heard Shri Pramod Kumar Mallick, learned counsel for the petitioner, and Shri Ranjeet Kumar Pandey and Dr. Indiwar Kumar, learned A.P.P. for the respondents.
The accusation against the petitioner is
Patna High Court Cr.Misc. No.22322 of 2014 (4) dt.20-01-2015 2/2 referable to the offences punishable under Sections307, 324 and 341/34 of I.P.C. It is brought to the notice of the Court that not only the charge-sheet was filed, but also almost all the prosecution witnesses were examined. Therefore, the detention of the petitioner is no longer warranted.
The petitioner is directed to be released on bail upon furnishing the bail-bonds of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of C.J.M., Rohtas in connection with Bikramganj P.S. Case No.226/2013.
