The petitioner seeks bail in Taraiyan Police Station (for brevity, PS) Case No 87 of 2014 instituted for the offence punishable under Sections 420, 467, 468 of Indian Penal Code. Allegation against the petitioner is of withdrawing some amounts from the Bank using a forged cheque from the Taraiyan Branch of the State Bank of India. Certain amounts have also been found to be withdrawn through Automated Teller Machine.

Learned counsel for the petitioner submits that it is a case of false implication. The petitioner is innocent. Learned APP for the State, from the case diary, points

Patna High Court CR. MISC. No.30065 of 2020(5) dt.01-02-2021 2/2 out that in the investigation, it has been revealed that the amount alleged to have been withdrawn by forged cheque was credited in the petitioner's account.

This Court, after considering the submissions of the rival parties, is not inclined to allow the prayer for anticipatory bail. The same is rejected.

Learned counsel for the petitioner is expected to honour his undertaking given in the instant proceedings today for depositing requisite Court fee and removing the defect (s), as pointed out, when called upon to do so.
