Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Phulwarisharif (Janipur) P.S. Case No. 913 of 2021 lodged under Sections 341, 323, 498A, 379, 504, 506 of the I.P.C. read with Section 3⁄4 D.P. Act.

Notices were issued in this case which has been returned unserved but O.P. No.2 has appeared through Vakalatnama. Learned counsel for O.P. No.2 submits that she is ready to live with her husband and husband is ready to keep his wife happily.

Patna High Court CR. MISC. No.31974 of 2022(3) dt.22-11-2022 2/2 Learned counsel submits that petitioner is husband and his antecedent is clean. He submits that under unfortunate circumstances, his wife has filed this case. Now, grievances has settled. Counsel submits that petitioner is in custody since 26.12.2021. Learned counsel for O.P. No.2 has no objection if he shall be released on bail. Learned counsel for O.P. No.2 submits that at the time of granting bail, an undertaking may be submitted by the husband that he will keep his wife with full dignity and respect.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Patna in connection with Phulwarisharif (Janipur) P.S. Case No. 913 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. Petitioner shall file an affidavit in this regard mentioned above.

With this observation, the bail application stands allowed.
