JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner, learned counsel for the complainant and learned APP for the State. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Complaint Case No. 50(C) of 2017 instituted for the offence under Sections 147, 148, 452, 380, 386, 307, 323, 504 of the Indian Penal Code and Section 27 of Arms Act. As per allegation in the FIR, the complainant's son and daughter-in-law used to assault and abuse the complainant with intention to grab her residential house. It is further alleged that this petitioner and other accused Virendra snatched wrist watch and Rs. 2000/- from the pocket of complainant's son-in-law and all persons also broke the wall of the complainant's room and took away Briefcase containing ornaments of gold and silver with Cash of Rs. 40,000/-.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has wrongly been made accused in this present case due to he is brother of co-accused Kajal Kumari. It is further submitted that he has no concern with the complainant. All the allegations against the petitioner are general and omnibus. Learned APP appearing for the state and learned counsel for the complainant have opposed the prayer of anticipatory bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Complaint Case No. 150(c) of 2017, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/-

Patna High Court CR. MISC. No.31217 of 2022(2) dt.22-11-2022 3/3 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Vaishali at Hajipur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
