====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 08-01-2021 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 364/34 and 302 of the Indian Penal Code.

Three other FIR named accused persons took to the son of the informant with them and thereafter dead body was found. In the statement before police, the informant said that he learnt that the petitioner also joined those persons. However, no witness stated before the police that the petitioner was seen along with other co-accused person. Petitioner has got no criminal antecedent. Petitioner is in custody since 25.09.2019. Investigation of the case against the petitioner is already complete.

Considering the facts aforesaid, let the petitioner,

Patna High Court CR. MISC. No.30851 of 2020(3) dt.08-01-2021 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.C. No. 03 of 2020 arising out of Bariarpur Police Station Case No. 140 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.

(c) The petitioner shall not leave the country without permission of the learned trial court.
