Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code.
As per the prosecution case, this petitioner along with other FIR named accused persons and 30-40 unknown persons abused the informant and his police team, attacked upon them, injured them by pelting brick and stones and sat on Dharna and jammed the traffic.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is no specific allegation against this petitioner of assaulting the informant and his team rather petitioner is only a member of unlawful assembly. Specific allegation of assault is
Patna High Court CR. MISC. No.41095 of 2021(5) dt.28-01-2022 2/2 against co-accused, Sandip Singh, who has already been granted bail by the court below. Petitioner claims clean antecedent and is in custody since 18.06.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt.
