JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 12-08-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has preferred this application for grant of regular bail in a case registered under sections 20, 21(b), 22 and 27 of the N.D.P.S. Act.

As per the prosecution case, two pudiyas of brown sugar weighing 0.50 grams were recovered from the right pocket of the jeans of the petitioner.

Learned counsel for the petitioner has submitted that

Learned counsel for the petitioner has further submitted that the alleged recovery of brown sugar is less than small quantity. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 08.12.2021.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge N.D.P.S, Patna, in connection with Phulwarisharif P.S. Case No. 1066 of 2021.

The application stands allowed.
