The petitioner apprehends his arrest in Adhaura P.S. case No. 88 of 2018 registered under Section 341, 323, 354 of the IPC.
The prosecutrix alleged that while she had gone to throw garbage outside the village the petitioner finding her all alone caught her hands and tried to take her to a lonely place but she raised alarm and her husband rushed to the place of occurrence.
The learned counsel for the petitioner submits that petitioner is next door neighbour of the informant. In fact the informant was throwing garbage in the field of the petitioner and when the petitioner forbid her not to throw garbage in his field some verbal altercation took place and the informant
Patna High Court CR. MISC. No.29071 of 2019(2) dt.03-05-2019 2/2 lodged the case making false allegation of catching her hands. During the course of investigation, the witnesses have also reiterated this fact.
Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that petitioner has got no criminal antecedent, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Adhaura P.S. case No. 88 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
