Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Akbarpur P.S. Case No. 133 of 2020, registered for the offence punishable under Section 302/201/34 of the Indian Penal Code. The petitioner is in custody since 06.03.2021. He is elder brother of the husband of the deceased. The father of the deceased is the informant. From the First Information Report itself, it appears that the marriage of the deceased was solemnized with the petitioner's brother ten years before the alleged date of occurrence.

Drawing my attention to the First Information Report, learned counsel appearing on behalf of the petitioner has

Patna High Court CR. MISC. No.41096 of 2021(3) dt.05-01-2022 2/2 submitted that there is vague allegation against all the family members of having killed the deceased on 03.03.2020. The First Information Report came to be registered nearly 13 days thereafter on 16.03.2020.

On perusal of the First Information Report, I do not find any specific allegation against the petitioner of any overt act or his participation in the alleged offence. Considering the above, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada, in Akbarpur P.S. Case No. 133 of 2020.
