2. Let the defect(s) as pointed out by the office, notes dated 08.05.2025 be ignored.

3. The petitioner has preferred this application for grant of regular bail in connection with (NDPS) Isuapur P.S. Case No. 42 of 2025 dated 28.02.2025 registered for the offences punishable u/ss 310(4), 310(5), 317(4) and 317 (5) of the B.N.S. and Section 8(c) and 21(b) of the NDPS Act.

4. As per the prosecution case, on secret information, some miscreants had assembled and they were making preparation to commit crime. The informant and the other police personnel reached the place of occurrence and four suspicious miscreants were apprehended who told their name as Dheeraj

An automatic loaded pistol having two live cartridges and mobile phone were recovered from the petitioner. Rs. 1,20,000/- and mobile phone were recovered from the co-accused, Suraj Kumar. Two live cartridges and mobile phone were recovered from the co-accused, Ravindra Kumar. Two live cartridges, knife, charas type material weighing 54 gm. and a motorcycle were recovered from the co-accused, Arman Babu.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged recovery. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 02.03.2025.

6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court

Case No. 42 of 2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.

(ii) The Court below shall verify the criminal antecedent of the petitioner and at any stage, if it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bonds of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the same of verification.

8. The application stands allowed.
