JUSTICE BIRENDRA KUMAR ORAL ORDER 31-07-2019 The report of the learned Trial Judge would reveal that the trial could not progress as another accused who was on bail did not cooperate in framing of the charges. Now charges have been framed and prosecution evidence is going on. In the circumstance, further six months time is allowed to the court below to conclude the trial from the date of receipt copy of this order.

Considering the nature of allegation that he was party to gang rape committed against the victim, I am not inclined to grant bail to the petitioner. Trial court shall proceed with the trial without allowing any unnecessary and long adjournment.
