JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Sections 307, 323 and some other allied sections of Indian Penal Code and u/s 27 of Arms Act.
As per the FIR, allegation against this petitioner is that he along with other accused persons armed with rifle assaulted the informant with butt of the rifle and also made firing.
Learned counsel appearing for the petitioner submits that though there is allegation of firing against the petitioner but nobody has sustained any fire arm injury. Moreover, there is general and omnibus allegation of assault against the petitioner. Similarly situated accused Anil Yadav and another have already

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate X, Gaya in Fatehpur P. S. Case No. 97 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) BKS/- U T
