The petitioner has prayed for the following reliefs:- (I) To pay gratuity with penal interest (II) To pay earned leave with penal interest (III)To pay Provident Fund amount with penal interest (IV) To pay dues salary of the petitioner's father (V) To pay other dues for which the petitioner may be found entitled to under rules.

Learned counsel appearing on behalf of the petitioner submits that the father of the petitioner late Upendra Ram died on 13.11.2010 while working as Panchayat Sewak at Birol

Patna High Court CWJC No.10806 of 2019(4) dt.17-06-2020 2/2 Block, District- Darbhanga.

It appears from para-7 of the writ petition that the petitioner received Rs. 3,40,691/- and rest amount has not been paid. It is vague statement without disclosing the particular head of death-cum-post retiral dues which has not been received by the petitioner.

Considering the fact that the father of the petitioner died in 2010, the writ petition is disposed of with direction to the respondents to ensure payment of death-cum-post retiral dues with details of calculation to the legal heirs entitled to such benefit, if not already paid, within a maximum period of three months from the date of receipt/production of a copy of this order.

In case the admitted dues are not paid to the petitioner /legal heirs of the deceased, the respondents shall be liable to pay 9% interest on the due amount from the date of filing of the writ petition till the date of actual payment. With the aforesaid, the writ petition stands disposed of.
