The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 406, 420, 467, 468 of the Indian Penal Code.

As per prosecution case, the FIR named accused along with other unknown persons have entered into a criminal conspiracy and they have transferred Rs. 34,800/- from the bank account of the informant which was proceeded of a Cyber crime.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR rather he has falsely been implicated in this case on the basis of confessional statement of

Patna High Court CR. MISC. No.33720 of 2023(2) dt.26-06-2023 2/2 other co-accused namely, Tinku Kumar before the police which is inadmissible in the eye of law. This petitioner has no concern with the alleged occurrence. A statement has been made in para3 of the petition that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 5.2.2023. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Buniyadganj P.S. Case No. 38 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., VIII, Gaya.
