The present writ petition has been filed for quashing the order dated 05.07.2013 passed by the Secretary, Bihar School Examination Board, Patna in pursuance to the order dated 23.06.2011 passed in C.W.J.C. no. 408 of 2006. 2.

At this juncture, it can be relevant to produce the order dated 23.06.2011 passed in CWJC no. 408 of 2006 hereinbelow :- " After some arguments, the learned counsel for the petitioner seeks permission to withdraw this application in order to enable the petitioner to file self-contained representation before the Secretary of the Bihar School

Patna High Court CWJC No.24684 of 2013 dt.09-04-2019 2/2 Examination Board.

This Application is, accordingly, permitted to be withdrawn with the aforementioned liberty.

It, is, however, made clear that the petitioner will have no liberty to more this Court again for the same cause of action."

Having regard to the order dated 23.06.2011, this Court finds that the petitioner has been debarred from moving this Court again for the same cause of action, hence the present writ petition is not maintainable.
