The petitioner apprehends his arrest in Kaler P.S. case No. 21 of 2018 registered under Section 406, 420. 467, 468, 471, 120B of the IPC.
The informant, in sum and substances, alleged that one Non Banking Company was running in Charminar market situated in front of the Kaler college. Anjum Praveen was main agent of the company. She deposited Rs. 15,000/- in the fixed deposit. The informant also deposited Rs. 200/- per month since July, 2012 but even after maturation the amount was not paid to the informant. The informant disclosed the name of other investors who deposited money in the Non Banking company, Indusweir Industries.
The learned counsel for the petitioner submits that petitioner is not named in the FIR. During the course of investigation name of the petitioner figured in the case on the basis of only fact that petitioner happens to be husband of Shaira Bano, one of the agents of Non Banking company. The

No.31679 of 2019(2) dt.13-05-2019 2/2 informant and other persons did not make any allegation that petitioner persuaded any persons or collected money from any investor/ customer to deposit in the company. Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that petitioner is husband of one of the agents of the company, namely, Shaira Bano, but there is no allegation against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Arwal in connection with Kaler P.S. case No. 21 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
