JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 06-10-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Amarpur P.S. Case No. 130 of 2016 registered under Sections 341, 332, 307, 504, 353 and 427 read with 34 of the Indian Penal Code.

It is contended that there is no truth behind the allegation that the petitioners caused any injury to any police personnel. As a matter of fact, when one Lakho Das, a family member of the petitioners was arrested by the police, the

Since the police failed to explain any reason for his arrest, some protest was made, but that anguished the police. Hence, a false and fabricated case has been instituted against the petitioners, who are all ladies. Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. Regard being had to the nature of allegation and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 130 of 2016 subject to the conditions as laid down under Section 438(2) Cr. P.C.
