2. The petitioner is apprehending his arrest in connection with Shrinagar P.S. Case No. 03 of 2024 for the offence punishable under Sections 379 and 411 of the Indian Penal Code, lodged on 16.01.2024 by the informant Pramod Kumar.

3. As per the prosecution story, the informant alleged that while sleeping, two accused persons entered and took away motorcycle/mobile. As the locals raised alarm, one person Kundan Sah was apprehended and he gave the name of this petitioner. This led to the F.I.R.

4. Learned counsel for the petitioner submits that his name has come in the confessional statement and has no criminal antecedent.

5. Learned APP Mr. Jitendra Kumar Singh on the other hand opposes the prayer submitting that not only this petitioner has been named as a co-accused, the Police during investigation found the case to be true, the F.I.R. is of January, 2024, the anticipatory bail application of the petitioner was rejected by the learned Sessions Judge in the month of July, 2024 and almost a year later, the present petition.

6. Considering the submissions put forward by the parties as also the allegation that has come coupled with the fact that the petitioner has delayed coming to the Court, in that background, no relief can be extended.

7. The anticipatory bail application stands rejected. (Rajiv Roy, J) vinayak/- U T
