2. The petitioner seeks regular bail, who is in custody in connection with Salimpur P.S. Case No. 07 of 2025, registered for the offence punishable under Sections 103(1) and 3(5) of the BNS and Section 27 of the Arms Act.

Based upon the prosecution report, it is alleged that on 05.01.2025, while the informant heard the sound of firing from the room of first floor, he rushed there and found that his grand-mother was shot dead by some unknown person. The informant-petitioner informed the police, based upon which the FIR came to be lodged.
4. Learned Advocate for the petitioner submitted that in fact the deceased Tara Devi had three sons, namely, Tunnu

After partition, they have been living separately and running their own business of carpenter and there was no reason or any motive to cause the death of the grand-mother. He further submits that in fact the sister of the petitioner had affair with one Gaurav Kumar @ Gaurav Yadav, which was vehemently protested by the petitioner and his grand-mother and later on, the petitioner and his family members solemnize the marriage of the sister of the petitioner with some other person and due to which Gaurav Kumar @ Gaurav Yadav had caused the death of the grandmother of the petitioner.
The petitioner also filed an application before the Director General of Police, Patna and to all the concerns, to investigate the matter in right direction, as the petitioner has nothing to do with the alleged occurrence. However, the police in course of investigation, implicated the name of the petitioner and later on, his confessional statement was recorded forcibly. Save and except the confessional statement, there is no other material. The petitioner bears fair antecedent and now he has been incarcerated since 07.01.2025.
5. On the other hand, learned APP for the State vehemently opposes the bail application and submits that the admittedly the alleged occurrence took place in the house of the
Patna High Court CR. MISC. No.31872 of 2025(3) dt.06-08-2025 3/3 petitioner, where he along with his wife were residing with the grand-mother. There was no access of any outsider to the house and, as such, the police in course of investigation found the complicity of the petitioner in collusion with his wife.
6. Considering the allegations and the materials collected during the course of investigation, this Court is not acceded to the prayer for grant of bail to the petitioner. Accordingly, the prayer for bail of the petitioner stands rejected, for present.
