====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-12-2020 Heard Mr. Sangeet Deokuliar, learned counsel for the petitioner and Mr. Arbind Kumar Pandey, learned counsel for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Piprakothi P.S. Case No. 371 of 2019 dated 18.11.2019 instituted for the offences under Sections 341, 323, 379, 506, 504 and 34 of the Indian Penal Code and Section 37(c) of the Bihar Prohibition and Excise Act, 2016.

From the accusation levelled in the FIR, it has been argued that the petitioner is only alleged to have taken Rs. 13,000/- from the shop of the petitioner and is also alleged to have snatched a chain from the brother of the informant.

Learned counsel for the petitioner has

Patna High Court CR. MISC. No.30340 of 2020(2) dt.17-12-2020 2/2 submitted that the act of assault has been attributed to the other accused persons and this allegation has been levelled only for bringing the petitioner in the net of the investigation.

Regard being had to the aforestated facts and taking into account the clean antecedent of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of ten weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Additional Sessions Judge-cum-Special Judge, Excise, East Champaran, Motihari in connection with Piprakothi P.S. Case No. 371 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
