Petitioners apprehend arrest in connection with Madhuban P.S. Case No. 423 of 2022 registered for the offence under section 307 and other allied sections of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this

Patna High Court CR. MISC. No.32634 of 2023(2) dt.14-07-2023 2/2 case due to dirty village politics. Similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this Court vide order dated 13.04.2023 passed in Cr. Misc. No. 7580 of 2023, as contained in Annexure-3. Petitioners have no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioners, above named, are directed to be released on bail on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Motihari, West Champaran in connection with Madhuban P.S. Case No. 423 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
