The petitioner seeks bail in a case registered under Section 304(B)/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner caused death of the daughter of the informant due to non-fulfilment of demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.10.2017 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The witnesses in paragraphs 8, 10, 11 of the case diary have categorically stated that the deceased had fainted. Thereafter she was taken for treatment and in course of

Patna High Court CR. MISC. No.29260 of 2019(4) dt.01-07-2019 2/2 treatment she died. There is no external or internal injury on the body of the deceased. No offence under Section 304(B) of I.P.C. is made out.

On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Hena Mustafa, Judicial Magistrate, First Class, Vaishali at Hazipur in connection with Lalganj P.S. case No.274 of 2017. (Sudhir Singh, J) Narendra/- U T
