The petitioner seeks bail in Bettiah (M) P.S. Case No. 806 of 2020, registered for the offence punishable under Sections 399, 402, 413 and 414 of the Indian Penal Code and sections 25(1-b)a, 26 and 35 of the Arms Act. As per the prosecution case, on receiving information about the assemblage of accused persons to commit crime a raid was conducted and from possession of this petitioner one live cartridge and one mobile has been recovered.

It is submitted on behalf of the petitioner that nothing has been recovered from conscious possession of this petitioner and alleged recovery of the live cartridge against the petitioner is planted. Petitioner is in custody since 01.01.2021. Investigation is complete.

Considering the facts and circumstances of the case,

No.41945 of 2021(2) dt.02-12-2021 2/2 the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah (M) P.S.
