====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-01-2021 Heard the counsel for the parties.

The petitioner along with three others was granted bail by this Court vide order dated 13.09.2019 passed in Cr. Misc. No. 43311 of 2019 in connection with Kesariya P.S. Case No. 123 of 2019 with a direction to them to surrender before the Court below within a period of six weeks and furnishing bonds in the sum of Rs.

Patna High Court CR. MISC. No.7464 of 2021(2) dt.29-01-2021 2/3 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount.

The learned counsel for the petitioner has approached this Court through the present application seeking extension of time for surrendering before the Court below.

For the reasons stated in the application for the extension of time for surrendering before the Court below, the prayer is allowed.

The order dated 13.09.2019 is modified to the extent that if the petitioner/Niranjan Kumar @ Niraj Kumar @ Niranjan Sah surrenders before the learned Court below within a period of four weeks from today, i.e., 29.01.2021, he shall be released on bail on his furnishing bail bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Chief Judicial Magistrate, East Champaran, Motihari in connection with Kesariya P.S. Case No. 123 of 2019, subject to the conditions as laid down under Section 438(2) of the

Patna High Court CR. MISC. No.7464 of 2021(2) dt.29-01-2021 3/3 Cr.P.C.

With the aforesaid modification, the application stands allowed.
