The petitioner has preferred this application for grant of regular bail in a case registered under sections 399, 402 and 414 of the Indian Penal Code, sections 25(1-B)(a), 26 and 35 of the Arms Act and sections 20 and 22 of the NDPS Act. As per the prosecution case, on a raid being conducted two live cartridges and a mobile phone was recovered from the possession of the petitioner and 5 kgs of ganja was recovered from the dickey of the car in which they were present. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case. He is in custody since 17.11.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for over 1 year and having no criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Gaighat P.S. Case no. 375 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 5th Addl. Sessions Judge, Muzaffarpur.
