2. The petitioner seeks anticipatory bail in connection with Mahua P.S. Case No. 304 of 2023 registered for the offence under Sections 302 and 120B/34 of the Indian Penal Code.

3. As per the prosecution case, all the accused persons are said to have killed the deceased by stabbing him.

4. The petitioner wants anticipatory bail in a case under Section 302.

5. Considering the fact that this is a case under Section 302 of the Indian Penal Code, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this application is dismissed.

7. The petitioner is given liberty to surrender and pray for regular bail. If the petitioner surrenders and pray for regular bail then the same shall be considered by the Court below without being prejudice from the rejection of anticipatory bail application.
