Under the transfer order issued on 07-11-2022, petitioners have been transferred inter-district. The transfer order indicates that the petitioners' are 'Office Attendants'. 3.
Learned counsel for the petitioner submits that all
2/4 the petitioners have joined their transfered place of posting. As per submission of the petitioners' counsel, such inter-district transfer of petitioners is unsustainable, in view of the erstwhile Personal and Administrative Reforms Department, letter dated 25-04-1984, bearing Memo No. 5038.

The transfer has been effected, considering the petitioners to be 'Office Attendants', whereas the petitioners are substantially employees, who were appointed in Class- IV post and the profile of their post has not substantially changed, other than nomenclature of the post.
Having submitted so, it is stated by the learned counsel for the petitioner that now the General Administration Department, Government of Bihar, has come out with a letter dated 26.05.2023, bearing Memo No. 9948, Clause 3 to 6, which is relevant, for the purposes of the present dispute, and is being reproduced herein:- "3.

3/4 पर कसायर्दरत कमर्मी अल्प विकतन भभोगव हभोतक हैं। इसवलए इनकक स्थसानसान्तरण कक संबसंध में पमूविर्द में संसमूवचत वनणर्दय कभो पनुनन पवरचसावरत वकयक जसानक कव आविश्यकतसा महसमूस कव गयव। अतन सम्यक वविचसारभोपरसान्त वनदिकश वदियसा जसातसा ह वक- "चमूसंवक कसायर्यालय पवरचसारव/पवरचसारव (वविवशष) कक पदि पर कसायर्दरत कमर्मी अल्प विकतन भभोगव हैं फलतन इन लभोगदों कभो एक स्थसान सक दिमूसरक स्थसान पर स्थसानसान्तरण करनक सक इन लभोगदों कभो कसाफव असनुवविधसा हभोतव ह एविसं नयक स्थसान पर इनकक ससामनक आविसास कव भव कवठिन समस्यसा आ जसातव ह. अतन इन लभोगदों कभो वविशकष प्रशसासवनक कसारणदों कभो छभोड़कर (जहसक पदि समसाप्त हभोनक पर, आवदि) एक स्थसान सक दिमूसरक स्थसान पर स्थसानसान्तरण नहहीं वकयसा जसाय। यवदि विक सवचविसालय में कसायर्दरत हैं तभो विक सवचविसालय में हव कसाम करमेंगक। यहव वस्थवत वविवभन्न अनुमसंडल तथसा प्रखसंड में कसायर्दरत कसायर्यालय पवरचसारव / पवरचसारव (वविवशष) पर भव लसागमू हभोगव पर स्विसास्थ्य अथविसा मनभोविपांवछत आधसार पर स्थसानसान्तरण कव कसार्दविसाई उनकक आविकदिन पर कव जसा सककगव।"

अतन अनुरभोध ह वक उपयनुर्दक्त कसंवडकसा-5 सक अपनक अधवनस्थ पदिसावधकसावरयदों / कमर्दचसावरयदों कभो अविगत करसातक हनुए इसकसा दिदढ़तसा सक अनुपसालन करनक हकतनु वनदिर्देवशत करनक कव कदपसा कव जसाय।"
6. Since such decision has now been communicated by the General Administration Department, Government of Bihar.
4/4 It is submitted that the same is required to be considered, and petitioners are entitled to the benefits due to them in the matter of their posting/s by placing reliance on the decision, as contained in letter dated 26-05-2023.
7. The petitioners would thus be at liberty to approach the Authorities for benefit in terms of the decision contained in letter dated 26.05.2023. If the petitioners submit their representations seeking benefit of the government decision dated 26-05-2023 within 6 weeks, the authority would be obliged to pass orders thereupon having due regard to the governmental decision/s and in accordance with law, within 8 weeks thereafter.
