2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 307, 354, 504 and 34 of the Indian Penal Code .
3. As per the prosecution case, this petitioner along with other co-accused persons armed with lathi, rod, sword and farsa assaulted the informant side due to which they sustained injuries.
4. Learned counsel for the petitioner submits that on account of cutting of soil, an altercation took place between the parties in which both sides sustained injuries. Case and counter case. Specific accusation of assault is against co-accused Sri
Patna High Court CR. MISC. No.34443 of 2024(2) dt.23-05-2024 2/2 Ram Chaudhary and Jairam Chaudary and so far as this petitioner is concerned, there is general and omnibus allegation against him. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Gopalganj , DistrictGopalganj in connection with Gopalganj ( Town) P.S. case No. 919 of 2023 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
