JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 This is an application for grant of anticipatory bail in connection with Sultanganj P.S. Case No. 150 of 2017, disclosing offences under Sections 448, 341, 504, 323, 325, 354 of the Indian Penal Code.

Allegation as per Farde-beyan is that informant has no son and having two daughters and for that reason, the petitioner wants to grab the property of the informant and for that purpose entered inside her house and abused and assault her, causing injury to her.

Submission of the learned counsel for the petitioner is that the F.I.R. itself shows that petitioner is nephew of the informant and there is dispute between the parties with regard to property. It has also been submitted that earlier in a proceeding under Section 107 of Cr.P.C. initiated at the instance of the

Patna High Court CR. MISC. No.29073 of 2019(4) dt.17-07-2019 2/2 petitioner, she has been bound down, against which, informant has moved before this Court in Criminal Writ Jurisdiction and the same was also dismissed, which will appear from the Annexure 3 of the Supplementary Affidavit.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Sultanganj P.S. Case No. 150 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he will not try to tamper with the evidence.
