The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,149,341,323,353,427 and 120B of the Indian Penal Code. The prosecution case got initiated on the basis of written report dated 02.04.2018 submitted by Ranvijay Singh, SubInspector of Police to the Station House Officer, Industrial Area Police Station, Hajipur to the effect that on 02.04.2018 during 'Bharat Band', five accused persons named in the FIR along with 100-125, including the petitioner were damaging the vehicles parked on the road and on intervention of the police, they abused the police and blocked the road.

It is submitted by learned counsel for the petitioner that the accusation is against the mob, but only on suspicion the

Patna High Court Cr.Misc. No.57938 of 2018(2) dt.20-09-2018 2/2 accusation has been levelled against him also. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

It is submitted by learned APP for the State that the petitioner is named in the FIR.

Considering the accusation against the mob, coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Vaishali at Hajipur, in connection with Industrial Area P.S. Case No.43/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

However, the learned Court below will be at liberty to cancel the bail bonds of the petitioner, if he gets involved in similar nature of offences.
