JUSTICE ARUN KUMAR JHA ORAL ORDER 12-07-2024 The present petition has been filed for modification of order dated 29.02.2024 passed by this Court in Cr. Misc. No. 68324 of 2023, whereby and whereunder the petitioner was granted anticipatory bail subject to one of the conditions that the bail bond of the petitioner will be accepted after proper verification of his permanent place of residence as it has been submitted that the petitioner permanently resides at Delhi. It was further made clear that In case it was found that the petitioner was not residing permanently at Delhi, his bail bond would not be accepted.

2. Learned counsel for the petitioner submits that

No.50409 of 2024(2) dt.12-07-2024 2/3 when the bail bolds were filed before the learned 4tg Additional Sessions Judge -cum- Special Excise -II, Nalanda at Biharsharif in connection with Laheri P.S. Case No. 630 of 2022 on 24.04.2024, the learned court below refused to accept the bail bonds for the reason that bail bond was to be accepted after verification of the address of the petitioner and it was also made clear that if the petitioner surrenders he would be taken into custody and after verification he would be released. Learned counsel submits that in these circumstances, the petitioner could not surrender before the learned trial court. Learned counsel for the petitioner further submits that the learned trial court may be directed to accept the bail bond of the petitioner provisionally and confirm the same after verification of the address and for this purpose the order dated 29.02.2024 be modified and time period for surrender be also extended.

3. Having regard to the submission, the order dated 29.02.2024 is modified to the extent that the bail bond will be provisionally accepted and thereafter when the verification process is complete it would be confirmed and time for surrender is extended by further four weeks from today.

4. With the aforesaid directions, the order dated 29.02.2024 stands modified to the aforesaid extent only.

5. Accordingly, the present petition stands disposed of.
