2. The petitioner apprehends his arrest in Special Case No. 04 of 2023 arising out of RC 2A/2020 registered for the offences punishable under Sections 120B, 420 of the Indian Penal Code and Section 7A of the P.C. Act, pending in the Court of learned Court of Exclusive Magistrates CBI at Patna.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.34433 of 2023(6) dt.06-11-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order, considering this fact that some of the co-accused have been granted anticipatory bail by the Co-ordinate Bench of this Court.
