BAJANTHRI) Date : 30-04-2024 The present MJC petitions is filed for non-compliance of the order dated 04.06.2020 passed in CWJC No.6151/2020. Limited direction to the petitioner to submit representation within
Patna High Court MJC No.1080 of 2020 dt.30-04-2024 2/2 a period of four weeks from 04.06.2020. The petitioner had submitted representation on 15.06.2020 and further direction to pass order within a period of four weeks whereas the orders of this court read with petitioner's grievance has been redressed only on 26.04.2024 there is enormous delay. The concerned respondent has failed to file application seeking extension of time in CWJC No.6151/2020, if there are any administrative difficulty or in the alternative matter should have been taken up before the Hon'ble Supreme Court. Neither of the exercise has been undertaken by the concerned respondent. There is delay of about more than three and half years, therefore, petitioner is entitled to litigation cost and it is quantified at Rs.10,000/- Cost shall be paid to the petitioner within a period of eight weeks from the date of receipt of this order.
2. Accordingly, the present MJC petition stands dropped. Reserving liberty to the petitioner to assail the order dated 26.04.2024 in accordance with law.
