The petitioner apprehends his arrest in connection with Basantpur P.S. Case No. 73 of 2019 registered under Sections 272, 273, 308, 34 of the Indian Penal Code and section 30 (a), 38, 41 of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that as per seizure list, 51 litres of IMFL has been recovered from the possession of co-accused. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no criminal antecedent.
Having considered the facts and circumstances of the
Patna High Court CR. MISC. No.29426 of 2019(2) dt.13-05-2019 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan in connection with Basantpur P.S. Case No. 73 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) shailendra/- U T
