JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-04-2023 The present writ petition has been filed seeking the following reliefs :- " (i) For issuance of an appropriate writ/s, order/s, Direction/s to respondents for providing protection and security to the petitioner to his life property situated at Khata No. 24, and 25, 60, 160, 71, 70, 74,26,69 admeasuring about 2.74 1/2 Acres of land which is Khatiyani land of the petitioner and jamabandi was created in name of his father and for which the petitioner has been paying rent to the state
Patna High Court CWJC No.9682 of 2022(2) dt.27-04-2023 2/3 but the private respondent with the help of his other brothers is creating nuisance by selling the land to different persons, even though title suit is pending and other litigations are also sub-judice but only to harass the petitioner, private respondent is creating 3rd party right by executing registered sale deed in their favour.
(ii) For issuance of an appropriate writ/s, order/s, Direction/s to the respondents to deny the registration of sale deed, executed by the private respondent for the land of the petitioner and for which he had already filed title suit and other criminal proceedings for manufacturing documents and cheating.
(iii) For issuance of an appropriate writ/s, order/s, Direction/s to the respondents to take appropriate legal action against the private respondent for his demeanor done adversely to the interest of the petitioner and selling his land to others without any Right, Title and Interest and forcing the petitioner to take shelter of competent court of civil jurisdiction by filing title suit against those persons in whose favour the respondent no. 7 (private respondent) has executed sale deed."
After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however,
Patna High Court CWJC No.9682 of 2022(2) dt.27-04-2023 3/3 seeks liberty on behalf of the petitioner to avail such other alternative remedies, as are otherwise available under the law. Liberty so sought, is granted.
