JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Complaint Case No. 152 of 2017 in which cognizance has been taken for the offences punishable under Sections 323, 341, 406, 420, and 504/34 of the Indian Penal Code.
Petitioner is said to have taken loan of Rs. 2,60,000/- from the complainant and refused to return the aforesaid amount. Submission on behalf of the petitioner is that the petitioner is a brick-kiln owner and as a matter of fact, the complainant had taken money from petitioner for supply of coal but failed to supply the coal.

No.60714 of 2018 (2) dt.08-10-2018 2/2 Be that as it may, regard being had to the above stated facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri, Rohtas in Complaint Case No. 152 of 2017 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
