1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Sections 436/34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and has been falsely implicated in the instant case by the informant. It is next submitted that two title suits are going on in between the petitioner and the side of informant. It is also submitted that the allegation of burning the house of the informant is general and omnibus in nature and the petitioner is in custody since 07.02.2024 and the charge sheet has been submitted.
4. Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.36006 of 2024(3) dt.12-07-2024 2/2 bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Lauriya P.S. Case No.237/2023.
6. However, if the learned trial court comes to a conclusion that the petitioner after being released on bail is trying to delay the trial in any manner, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner. (Satyavrat Verma, J) amit/- U T
