2. Learned counsel appearing for the petitioner submitted that a report was called for regarding stage of trial vide order dated 06.10.2023 of this court.

3. The aforesaid report has been made available to this court by learned trial court through Letter No. 1961 dated 30.10.2023, from where it transpires that all prosecution witnesses have already been examined in this case and matter is fixed for statement under Section 313 of Criminal Procedure Code.

4. At that stage, learned counsel after going for short argument seeks permission from this court to withdraw present

Patna High Court CR. MISC. No.39624 of 2023(9) dt.10-11-2023 2/2 petition in view of the fact as prosecution witnesses have already been examined in this case.
