2. This application has been filed for issuance of a writ of mandamus directing the independent investigating agency i.e. CBI/ SIT to do impartial investigation, as the petitioner has been allegedly harassed, tortured and illegally

Patna High Court CR. WJC No.1002 of 2025(2) dt.08-07-2025 2/2 detained by the police, on reasonable doubts without even registering any F.I.R or complaint, which itself is the violation and infringement of Fundamental rights enshrined under Article 21 of the Constitution of India. The petitioner prays for demanding compensation against the illegal action performed by the police authorities, as the illegal detention in police lockup for more than 3 days harmed the reputation and self-esteem only based on merely a suspicion is reflecting the constitutional concomitants of the fundamental rights of right to person liberty and freedom, for the ends of justice.

3. The learned counsel for the petitioner has submitted that the petitioner has approached the Bihar Human Rights Commission vide Diary Nos. 1037/2024 and 815/2025 and no action is being taken.

4. This application is disposed of with a direction to the Bihar Human Rights Commission to consider the complaint of the petitioner and dispose of the same in accordance with law at the earliest.
