The petitioner seeks regular bail in connection with Amarpur P.S. Case No. 732 of 2025 registered for the offence under Section 96 of Bharatiya Nyaya Sanhita and the Charge sheet has been submitted under Section 96, 65(1) of Bharatiya Nyaya Sanhita and under Section 4 of POCSO Act.

As per prosecution case, the petitioner is accused of kidnapping the victim girl for the purpose of marriage. The petitioner is in custody since 17.01.2026. 4.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence at all. He further submits that the victim has not supported the

Patna High Court CR. MISC. No.31577 of 2026(3) dt.24-07-2026 2/2 prosecution case in her statement.

The victim girl in her statement recorded under Section 180 of the B.N.S.S. has stated that she left her house out of her own will.

Considering the statement of the victim girl recorded under Section 180 of the B.N.S.S., this bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum Special Judge, POCSO Banka/concerned Court below, in connection with Amarpur P.S. Case No. 732 of 2025.

It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
