JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Petitioner is languishing in custody since 14.07.2013 in a case registered for the offences punishable under Section 395 of the I.P.C.

It is alleged that informant's motorcycle and bag were robbed. Subsequently on the confession of the petitioner engine of the motorcycle and firearms purchased from the robbed money were recovered from one of the relatives of the petitioner.

It is submitted by learned counsel for the petitioner that there is no recovery from the conscious position of the petitioner nor the petitioner has been put on test identification parade till date. The statements to that effect have been made in para 5 and 9 of the petition. Considering the fact that petitioner has not been put on test identification parade, let the petitioner, above

Patna High Court Cr.Misc. No.16428 of 2014 (3) dt.09-02-2015 2/2 named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Khaira P.S. Case No. 56 of 2013.

Since petitioner is accused in six other cases, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial. (Dinesh Kumar Singh, J) Shageer/- U T
