The petitioner seeks bail in a case registered under Sections 147, 149, 341, 323, 324, 307, 354/34 of the Indian Penal Code.

The prosecution case in short is that the accused persons were constructing house forcibly on the land of the informant and on protest, the son of the informant was assaulted with Dabiya, as a result of which, injury was sustained by son of the informant.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 13-03-2019. Charge sheet has already been submitted. There is case and counter case

Patna High Court CR. MISC. No.30641 of 2019(3) dt.19-06-2019 2/2 between the parties. The injury on the side of the accused has not been explained by the prosecution. The prosecution has not come with clean hands.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Birpur in connection with Pratapganj P.S. Case No. 114 of 2017.
