2. The petitioner seeks bail in connection with Shankarpur P.S. Case No. 93 of 2024 registered for the offence punishable u/s 341, 323, 324, 307, 332, 333, 353, 224, 504, 506 and 34 of the IPC and Section 27 of the Arms Act.

3. As per the prosecution case, petitioner and other coaccused persons assaulted the informant with an intention to kill him.

4. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has not committed any offence as alleged in the FIR. He has been falsely implicated in this case due to enmity. It is further submitted that there is no eye witness to the alleged occurrence and the allegations are

Patna High Court CR. MISC. No.31399 of 2025(2) dt.16-05-2025 2/3 general and omnibus in nature. There is no specific overt act against the petitioner. It is lastly submitted that the petitioner has no criminal antecedent and he is in judicial custody since 19.03.2025.

5. Learned APP for the State opposed the prayer for bail

Considering the facts and circumstances of this case and taking into account that there is no eye witness to the occurrence and that there is no specific overt act against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending the Successor Court, in connection with Shankarpur PS. Case No.93 of 2024 subject to the conditions that a. One of the bailors of the petitioner shall be her close relative.

b. The petitioner shall remain physically present in Court on each date of the trial.

c In case of absence on two consecutive dates, or in violation of the terms of the bail and if the prosecution is found involvement of the petitioner in similar nature of offence, the bail

d And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the abovementioned order shall not be delayed for purpose of or in the name of verification.
