2. This is the second attempt for bail of the petitioner for grant of regular bail as earlier the bail application of the petitioner was rejected vide order dated 24.05.2023 passed in Cr. Misc. No. 34484 of 2023.

3. The petitioner seeks bail in connection with Nawada Town P.S. Case No. 378 of 2021 registered for the offence punishable under Sections 33, 34 and 36 of the Bihar Prohibition and Excise Act, 2016.

4. The petitioner is in jail since 18.01.2023. Earlier the bail application of the petitioner was rejected because of his criminal antecedent. The petitioner submits that he will give an undertaking in the Court below that he will not involve himself

5. Considering the facts and circumstances of the case, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge, 1st, Nawada in connection with Nawada (Town) P.S. Case No.378 of 2021.

7. The petitioner will also give an undertaking in the Court below at the time of furnishing his bail bonds with an address in the undertaking that where he will stay outside Bihar. The petitioner will stay on the address given by him in the undertaking after being released on bail and will visit Bihar only on the date fixed in the present case as well as in other cases in which he is an accused and is required to visit the Court.
